By downloading or using Mylage ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.
1. Overview
Mylage is a mileage and trip tracking application for iOS. The App records your travel distances, routes, and trip details using your device's location services. All data is stored locally on your device and optionally synced via your personal iCloud account.
2. Eligibility
You must be at least 13 years old to use the App. By using Mylage, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple device you own or control, subject to the Apple Media Services Terms and Conditions. This license does not allow you to:
- Reverse-engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Distribute, sublicense, lease, rent, or lend the App to third parties
- Use the App for any illegal purpose or in violation of any laws
4. In-App Purchases
Mylage offers optional premium features ("Mylage Pro") available through in-app purchase. Purchases are processed by Apple and subject to the App Store's terms:
- Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends
- Lifetime purchases are one-time payments that unlock Pro features permanently
- Refunds are handled by Apple. Contact Apple Support or use the "Report a Problem" link in your purchase receipt
- Prices may change. We will notify existing subscribers before any price increase takes effect
You can manage or cancel subscriptions in Settings > Apple Account > Subscriptions on your device.
5. Accuracy Disclaimer
Mylage relies on your device's GPS and motion sensors to estimate distances and detect transport modes. These measurements are estimates and may not be perfectly accurate. Factors affecting accuracy include:
- GPS signal quality (urban canyons, tunnels, dense foliage)
- Device hardware and battery optimization settings
- Environmental conditions and satellite availability
Mylage is not a certified odometer or measurement instrument. Do not rely solely on Mylage for IRS filings, legal proceedings, insurance claims, or any situation requiring certified distance records. We recommend corroborating mileage data with your vehicle's odometer or other official records.
6. Your Data
You own your data. Mylage does not claim ownership of any trip records, locations, or other data you create within the App. As described in our Privacy Policy, your data is stored locally on your device and optionally in your personal iCloud account. We do not have access to it.
You are responsible for maintaining backups of your data. Deleting the App will permanently remove all locally stored data.
7. Acceptable Use
You agree not to use the App to:
- Violate any applicable law or regulation
- Track or monitor another person without their knowledge and consent
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to any systems or data
8. Intellectual Property
The App, including its design, code, graphics, animations, and content, is protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
The Mylage name, logo, and branding are trademarks. You may not use them without prior written permission.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy of distance calculations, trip detection, or location data.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYLAGE OR ITS DEVELOPERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use or inability to use the App
- Inaccurate distance measurements or trip data
- Loss of data due to device failure, App deletion, or iCloud issues
- Any unauthorized access to your data
Our total liability for all claims related to the App shall not exceed the amount you paid for the App or in-app purchases in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Mylage and its developers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
12. Termination
We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us. Upon termination, your license to use the App is revoked. Your locally stored data remains on your device.
13. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the App after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
15. Apple-Specific Terms
These Terms are between you and Mylage, not Apple. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App.
